Ragratech – GENERAL TERMS AND CONDITIONS OF ONLINE SALE

The detailed General Terms and Conditions of Sale below govern the contractual relationship between any user of the website ragratech.com, published by SASU RAGRATECH, with a capital of €4,000, whose registered office is located at 424 Rue de La VALADE, 33390 Saint-Genès-de-Blaye, registered with the Bordeaux Trade and Companies Register under number B 934 049 123, intracommunity VAT FR32934049123, SIRET 93404912300011. The company can be contacted by email via the contact form accessible on the homepage of ragratech.com.

PREAMBLE

The Seller is a publisher of products and services for consumers via its website ragratech.com. The list and description of goods and services offered by the Company can be viewed on the aforementioned site. The company's activity is presented and explained, along with the intended use of the products sold to consumers (cf. Art. L111-1 of the French Consumer Code).

Article 1: Purpose

These General Terms and Conditions of Sale define the rights and obligations of the parties in the context of the online sale of Products offered by the Seller. The contract establishes the obligations of the parties (Seller: deliver the goods; Buyer: pay the price) – in accordance with the information obligation imposed by Art. L111-1 of the Consumer Code.

Article 2: General Provisions

These General Terms and Conditions of Sale (GTC) apply to all sales of Products, whether conducted in-store or on the Company’s websites, and form an integral part of the Contract between the Buyer and the Seller. The Seller reserves the right to modify these terms at any time by publishing a new version on its website. The applicable GTC are those in force on the date of payment (or the first payment in case of multiple payments) of the order. These GTC can be viewed on the Company’s website at: ragratech.com.

The Client declares that they have read and fully accept these General Terms and Conditions of Sale, as well as any Special Terms and Conditions related to a product or service, without reservation. The Client acknowledges having received the necessary advice and information to ensure the suitability of the offer to their needs. The Client declares that they are legally capable of contracting under French law or duly represent the individual or legal entity for whom they are acting.

Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.

Article 3: Supremacy

These General Terms and Conditions of Sale apply by default to commercial relations between RAGRATECH and its customers for in-store and online sales. They apply to any customer making a purchase at a RAGRATECH store or on ragratech.com with direct delivery.

Any customer placing an online order but picking up their goods in a RAGRATECH store will be invoiced at the time of pickup, and the sale will not be considered a distance sale but rather an in-store sale (the right of withdrawal for private individuals will therefore not apply).

Any derogation from these conditions must result from a contractual agreement or special sales conditions for certain products. Any order implies the Buyer’s unreserved acceptance of these terms and their waiver of any stipulations that may appear on their own orders or correspondence, unless RAGRATECH provides written derogation. The applicable GTC are those in force at the time of the order.

Article 4: Orders

Product availability and delivery times are displayed on the Site for each product page. RAGRATECH reserves the right to refuse payment and not confirm an order for any legitimate reason, particularly in case of supply issues or difficulties concerning the received order.

At the time of purchase, the customer is informed that spare parts are available for at least three months after purchase.

Article 5: Online Orders

For the first online order, each new customer must create a "customer account" (a login and password will be required). Upon order validation, you will be redirected to your account via a secure connection summarizing your order.

Your order can be modified at any time before final validation. It will only be definitively recorded after providing all required information and confirmation. If payment is not received, the order is automatically canceled.

We archive order forms and invoices on our servers. The contract is validly concluded through the "double-click" procedure. You may review your order details and total price and correct any errors before confirming your acceptance. Order confirmation is sent via an automatic email generated by our website to the email address provided when creating the customer account.

Article 6: Pricing

Products are sold subject to stock availability at the time of order, at the current prices listed in RAGRATECH’s price list, expressed in Euros on the order date. Unless stated otherwise, prices in catalogs, brochures, and price lists may be modified without notice in compliance with applicable regulations.

Unless otherwise specified, prices on order confirmations are firm and non-revisable. Any billing error must be reported by registered mail with acknowledgment of receipt within eight days of the invoice date.

By express agreement, only the numbered invoice issued by RAGRATECH is authoritative, regardless of any documents previously provided. Accepted payment methods are listed on the website’s homepage.

The validity period of a credit note issued by RAGRATECH is 6 months from its creation date. To use a RAGRATECH credit note, the original must be presented.

Article 7: Payment

7.1. Full Payment

7.1.1 Payment for Orders (Excluding Click & Collect)

For all orders, RAGRATECH accepts the following payment methods:

  • Credit/Debit Card: Carte Bleue, e-Carte Bleue, Visa, Mastercard, American Express.

  • PayPal: You will be automatically redirected to your PayPal account.

7.2. Installment Payments

7.2.1. PayPal Installments

If you choose to pay in installments, you accept PayPal’s general terms. The "Pay in 4" option is available when offered.

7.3. Order Validation

Once payment is completed on ragratech.com, the order is registered, and you will receive an order summary via email at the address linked to your customer account.

RAGRATECH reserves the right to suspend any order processing and delivery in case of payment refusal by accredited financial institutions or non-payment.

As part of fraud prevention, RAGRATECH may request identity verification. In such cases, order processing will begin upon receipt of the required documents. If documents are not received or are deemed non-compliant, the order may be canceled.

Article 8: Delivery & Shipping

Our company delivers the goods no later than 30 days after the contract is concluded in France. If delivery fails within this period, the customer may terminate the contract by registered mail with acknowledgment of receipt.

The Buyer must refuse delivery if a package is damaged, missing, or repackaged. The risk of loss or damage transfers to the Buyer when they (or a third party other than the carrier designated by RAGRATECH) take physical possession of the goods (Art. 216-2 of the Consumer Code).

We recommend:

  • Refusing delivery if the package is damaged, opened, or repackaged.

  • Otherwise, noting precise and detailed reservations on the delivery slip.

  • Immediately checking the package contents and contacting us if any items are damaged or missing compared to the packing list.

For carrier disputes, send a registered letter (LRAR) within 3 days of receipt to preserve recourse (Art. L133-3 of the Commercial Code).

Article 9: Retention of Title

The Seller retains ownership of the sold goods until full payment (including ancillary costs). The issuance of a payment obligation (e.g., promissory note) does not constitute payment under this clause. Failure to pay any installment may result in the repossession of the goods.

These provisions do not prevent the transfer of risk of loss or damage to the Buyer upon delivery.

Article 10: Warranties

If an issue arises with a product, please contact our Customer Service via your client account or at contact@ragratech.com.

Warranty Exclusions:

  • Altered, erased, or illegible serial/type numbers.

  • Unauthorized repairs, modifications, or transformations.

  • Defects due to neglect, misuse, non-compliance with instructions, normal wear and tear, third-party intervention, external causes (accidents, power surges, lightning, etc.), or improper installation/use.

Excluded from Warranty Coverage:

  • Dead pixels or colorimetry defects.

  • Damage from unauthorized modifications.

  • Cosmetic damage (scratches, dents) not affecting functionality.

  • Virus-related damage.

  • Accidental damage (drops, spills, power surges, natural disasters).

  • Professional/commercial overuse (rental, mining, public use).

  • Oxidation, sand/water/dust exposure.

  • Consumables (batteries, ink cartridges).

  • Data loss (no liability for hard drive failures).

  • Lost profits or indirect damages.

If a repair is not covered, RAGRATECH will provide a diagnostic and repair quote.

10.1. Legal Conformity Warranty (FOR PRIVATE CUSTOMERS ONLY)

Under the legal conformity warranty, consumers have 2 years (or 12 months for used goods, per Art. L217-7 of the Consumer Code) from delivery to request a repair or replacement (or refund if unresolved within 1 month).

The consumer does not need to prove the defect (except for used goods). This warranty applies independently of commercial warranties. Consumers may also invoke hidden defects under Art. 1641–1649 of the Civil Code.

10.2. Hidden Defects Warranty (FOR PRIVATE CUSTOMERS ONLY)

Consumers benefit from a 2-year hidden defects warranty (from defect discovery) under Arts. 1641–1649 of the Civil Code, entitling them to a price reduction or full refund. Conditions:

  1. The defect was not apparent at purchase.

  2. It severely hinders usability.

  3. It existed at purchase.

10.3. Commercial Warranty

  • New products: 2-year warranty (return to our workshop with invoice & RMA form).

  • Used products: 12-month warranty.

  • Repairs take 3–7 weeks.

This warranty does not affect legal rights under the Consumer Code or Civil Code.

10.4. Manufacturer’s Warranty

For products with manufacturer warranties (on-site/extended), the Client must contact the manufacturer directly. RAGRATECH assumes no liability for manufacturer defects and will not accept returns under this warranty.

Article 11: Right of Withdrawal (ONLY FOR DISTANCE SALES & NON-EXCLUDED ITEMS)

Under Art. L221-18 of the Consumer Code, Buyers have 14 days from delivery to withdraw. They then have 14 more days to return the product.

Exclusions:

  • Unsealed software/audio recordings.

  • Custom-made/assembled parts.

  • Perishables (ink cartridges, unreturnable hygiene items).

Return Process:

  1. Contact us via your client account or contact@ragratech.com.

  2. Return goods in original packaging at your own cost/risk to our headquarters.

  3. No in-store returns accepted.

Refunds will be processed within 14 days of receipt (excluding premium shipping fees).

Article 12: Complaints & After-Sales Service

For returns, contact us via your client account or contact@ragratech.com.

  • Defective items: Return within 7 days of approval.

  • Full original packaging required (unless instructed otherwise).

  • Labels must be intact (voids warranty if removed).

  • Return authorization number (SAV) must be visible on the package.

If the Buyer uses a non-RAGRATECH carrier, they assume all risk of loss/damage.

Article 13: Intellectual Property

Trademarks, domain names, products, software, images, videos, texts, or any intellectual property remain the exclusive property of the Seller. No transfer of rights is granted under these GTC. Reproduction, modification, or unauthorized use is strictly prohibited.

Article 14: Personal Data Protection

Under the French Data Protection Act (1978) and GDPR, you have the right to access, rectify, port, or delete your data. You may unsubscribe from promotional emails at any time.

Article 15: Jurisdiction

Any dispute regarding these GTC falls under exclusive French jurisdiction. Consumers may use the EU Online Dispute Resolution Platform:

Under Art. L.221-18 of the Consumer Code, I hereby exercise my right of withdrawal.

Please refund the full amount (including standard delivery fees) within 14 days of receiving this return, per Art. L.221-24 of the Consumer Code.

The returned item is enclosed, shipped at my expense and risk.
